Con el presente auto se dispone la terminación del incidente de recusación instaurado por el Director Jurídico de la Fiscalía General de la Nación contra el doctor Jorge Ignacio Pretelt Chaljub, en el trámite del expediente D-10339.

Lo anterior, en virtud del escrito presentado por el Magistrado donde se declara impedido y solicita a la Sala Plena de la Corporación separarlo para conocer del trámite de dicho proceso.

Con este proveído se resuelve también, separar inmediatamente al Magistrado Pretelt del conocimiento de la demanda de inconstitucionalidad de la referencia y ordenar dar trámite a la solicitud de nulidad elevada por el ente investigador.

  1. Primero. DISPONER la terminacion del incidente de recusacion presentado por el Director Juridico de la Fiscalia General de la Nacion contra el Magistrado Jorge Ignacio Pretelt Chaljub, en el tramite del expediente D- 10339, por las razones expuestas en la parte motiva de esta providencia.
  2. Segundo. SEPARAR inmediatamente al Magistrado Jorge Ignacio Pretelt Chaljub del conocimiento del proceso de control de constitucionalidad D- 10339.
  3. Tercero. ORDENAR dar tramite a la solicitud de nulidad elevada por el Director Juridico de la Fiscalia General de la Nacion, en el proceso D- 10339.
  4. Cuarto. Contra esta decision no procede recurso alguno.
